ABSTRACT

Prior consultation with Indigenous Peoples is still very poorly implemented in Paraguay. However, some Indigenous participation processes have been promoted in the formulation of public policies, especially for the approval of laws concerning health and education, with the significant support of non-governmental organisations. Indeed, the Constitution recognises Indigenous rights, and the country has a legal framework that favours the participation of Indigenous Peoples. Hence, the objective of this chapter is to offer an overview of the status of the implementation of the prior consultation of Indigenous Peoples in Paraguay. It also analyses the current legal framework and actions taken to adopt the “Protocol for the Consultation process and Free, Prior and Informed Consent with the Indigenous Peoples living in Paraguay”, which was adopted at the end of 2018.
