ABSTRACT

Cash bail – the upfront monetized payment for release from jail – has come to the forefront of criminal justice scrutiny. It has been contested that this system is designed to target socioeconomic disadvantaged populations in addition to other discriminatory practices based on race and gender. This chapter examines the response to cash bail through various forms of activism, which include spreading awareness about the inequity, advocating policy reform, and undermining the system through various campaigns. Moreover, the bail system in the United States is directly linked to reentry as it determines an individual’s opportunity to return to their family and community prior to adjudication of their case.
