ABSTRACT

The new Law on the Legal Protection of Personal Data came into force on 1 July 2003. According to Article 3.2 of the Law on the Legal Protection of Personal Data, personal data collected for other purposes may be processed for historical or research purposes on the condition that adequate safeguards have been established. It does not seem that Lithuanian law implies the requirement to obtain consent if there are other conditions under which data processing might be processed. The application of a personal identification number is regulated by Article 7 of the Law on Legal Protection of Personal Data. It appears that Article 21 of Law on the Legal Protection of Personal Data completely corresponds to the provisions of the Directive. Article 26 of the Law on Legal Protection of Personal Data deals with the procedure of the prior checking. Medical research is treated as a special sector of scientific research.
