ABSTRACT

This chapter provides intellectual property rights as currently protected in Cyprus. The authorities in Cyprus endeavour to adhere strictly to the law so as to ensure the protection of intellectual property rights against infringement. The rights conferred by Community designs are enforced by an infringement action in a national Community design court. The Community Designs Regulation 6/2002 (CDR) establishes two types of designs, which are the registered Community design and the unregistered Community design. The unitary regime under the CDR leaves national registered design protection systems, as harmonised by Directive 98/71/EC, unaffected. Cypriot patents law Until recently the protection of patents in Cyprus was governed by Chapter 266 of the Laws of Cyprus. The registration and protection of marks in relation to goods and services is governed by the Trade Marks Law (TML), Chapter 268 of the Laws of Cyprus, as amended by Laws Nos.63/1962, 69/1971 TML, the trade marks regulations and the general principles of common law.
