ABSTRACT

This chapter deals with the World Trade Organisation (WTO) agreement on Technical Barriers to Trade (TBT) agreement, which is of considerable importance within the environmental policy field, and looks at the links between it. The obligations laid down in the TBT Agreement vary between technical regulations and standards and the competent bodies concerned. The chapter outlines basic provisions of the WTO Agreement on the application of Sanitary and Phytosanitary Measures (SPS) agreement. The agreement on the application of SPS Agreement applies to all SPS that may, directly or indirectly, affect international trade. Members shall ensure that they rely on the services of non-governmental entities for implementing sanitary or phytosanitary measures only if the entities comply with the provisions of the SPS Agreement. SPS that conform to international standards, guidelines or recommendations shall be presumed to be consistent with the relevant provisions of the SPS Agreement and of general Agreement on tariffs and trade 1994.
