The difference between the kidnapping from Peru and Alvarez, of course, was that there was no American government involvement in the former case and the Peruvian government had not protested as Mexico did. Alvarez was indicted for several crimes, including conspiracy to kidnap and kidnapping a federal agent, and the felony murder of a federal agent. The kidnapping of Alvarez undoubtedly violated Mexican law, and Mexico asked for the extradition of those it thought responsible for trial in its courts. The chief justice noted that the Ker decision the position of the United States that the case applied to forcible abductions made outside the United States-Mexico treaty, had been brought to the attention of the Mexican government as early as 1906.
