ABSTRACT

So where will the future battleground(s) of the First Amendment be? As suggested by the previous chapter, Internet expression may be the issue that attracts the most attention in the first half of the 21st century. As a new medium, the Internet is a setting likely to be the focus of a tug-of-war attempting to shape the boundaries of acceptable content. At the conclusion of the previous century and into the present, repeated efforts were made to proscribe specific kinds of content on computer-mediated communication formats. Virtually without exception, these legislative efforts were ruled unconstitutional. And virtually without exception, lawmakers were unrelenting in their endeavors to craft measures that could withstand constitutional challenges.
