ABSTRACT

Contract law may seem far removed from the fascinating search for clues at a crime scene by forensic scientists. The reality, however, is that, in any significant case involving an alleged breach of contract, the meticulous pursuit of evidence is the critical foundation to determine the rights and duties of the parties. In this sense, contract law may be characterized as the law of “forensic agreements.” To appreciate how lawyers and courts pursue forensic agreements, it is essential to have a preliminary understanding of the nature of “contract” and “agreement.”
