ABSTRACT

To constitute a patentable invention, it is necessary for the invention to satisfy the requirements of s 1(1) of the PA 1977. Section 1(1) requires an invention to be the result of an inventive step, to be novel, capable of industrial application and not be excluded. In the question, there is nothing to suggest that the patent will fail through it involving any excluded matter or lack of industrial application – the gliding canoe could be made the subject of manufacture.
