ABSTRACT
The publication and dissemination of true and accurate information may be actionable at law if the information was originally received under a duty of confidence. The origins of breach of confidence lie in equity. Its exact basis is unclear, and foundations in contract, tort and common law have all been proposed. In Frazer v Evans (1968), the basis was proposed to be one of ‘good faith’ (per Lord Denning).
