ABSTRACT

The Advertising Code defines ‘advertising agency’ as a ‘commercial company existing for the sole purpose of carrying on advertising business’.

Besides the determination of the corporate object of advertising agencies, Portuguese Law does not establish any other legal requirement or restrictions to the incorporation or performance of their activity. In fact, there is no licensing procedure or any special authorisation to allow the carrying out of this activity in Portugal. Therefore, any person may set up an advertising agency, provided that it is incorporated as a commercial company with the above-mentioned object.
