ABSTRACT
Thus, in considering the doctrine of proportionality, the domestic judiciary may find guidance in the principles enunciated at Strasbourg, but not in the outcome of particular decisions, in which particular forms of interference have been found to be proportionate to the legitimate aim in view, such as the prevention of disorder, or the 'rights of others'.
