The applicant was a teacher of religious education expected to teach Catholic principles. She became pregnant as the result of a relationship with a Roman Catholic priest in the locality. Effectively she was forced to leave her post. It was accepted that the dismissal was unfair but the issue was whether it was also a case of sex discrimination. The tribunal said it was a mixed motives case and that pregnancy per se was not the dominant motive for the dismissal. The EAT allowed the appeal.
