The unusually fast adoption of a Directive on such a complex topic can be explained by the high priority given to this proposal by the Commission, combined with the political pressure to adopt a meaningful measure at the Community level to prepare for the implementation of the Kyoto Protocol, and almost unprecedented widespread support for the proposal from key sectors of industry and NGOs. Although the key elements of the original Commission proposal have remained intact, the adoption process did not go without difficulty, and the final text of the Directive shows the scars of the negotiations that took place in Parliament and Council. The key issues in these negotiations included the binding nature of the trading regime, its coverage of sectors and gases, its link with the Kyoto Protocol flexible mechanisms, the allocation of allowances (method and total quantity) and the issue of penalties.
