ABSTRACT

The minimum expectation from the judges was to have dutifully and even religiously applied the basic standard that is demanded by the rule of law. The respected Archbishop seemed to have his head in the clouds in the criticism, because even in municipal law, justice is never blind to wealth, power, and influence, much less the still-fledgling international law. The inviolability of a sovereign is one of the very strong pillars of the law of nations. In international politics, as the game of power politics goes, colours are good only if spotted by the python; any lesser animal that does it ends up in the maw of the mighty python. The jurisdiction of the International Criminal Court is over individuals and not the state. It was this reality that compelled the United States, even though not a party to the Rome Statute, to begin to sign non-surrender pacts with some members of the court, including Nigeria.
