ABSTRACT

The media environment in Iceland is rather diverse and multiform. Some of the most relevant questions regarding the legal environment of online media in Iceland relate to the scope of the Media Act. To the extent that the Act covers online media, the media service providers are obliged to register with the Media Commission and adhere to the many duties prescribed in the Act. The chapter describes the liability rules applying to online media covered by the Act and discusses what rules apply to online media not falling under the Act. It presents some thoughts on how recent judgments from the ECtHR will affect domestic liability rules in Iceland. Iceland is also bound by other international conventions on human rights, for example, the United Nations International Covenant on Civil and Political Rights. The Icelandic legal system is based on the theory of dualism.
