ABSTRACT
Since the foundational period and the minimalist and non-interventionist approach of the
Community in the social field which relied heavily on the Ohlin and Spaak reports that
argued that the functioning of the market would ensure conditions close to levels of Pareto
optimality, EU labour law and policy have undergone different paths of evolution and
involution which highlight its fragmented structure.
