ABSTRACT

This chapter explores the seven sets of documents that comprise the case file. Investigations are, then, an important business improvement tool and an integral part of a longer process. Any International non-governmental organisations (INGO) considering conducting an investigation should seek expert advice, including contextual legal advice. There is huge international variation in terms of the relevant laws, conventions and practices, and expectations of internal investigations. Investigations are risk-rich activities, not only helping to manage existing risk but also creating fresh risk. It should identify issues, considerations and risks, and set out strategies, across the major components of an investigation: suspect management; witness management; confidential reporter management; exhibit management; resource management; unused material; electronic evidence and risk assessment. Investigations could encounter a diverse array of items, from financial or logistics documentation to Closed-circuit television (CCTV), flash drives or other property.
