ABSTRACT
The courts in Canada play an important role in adjudicating the disputes that arise over the rules that govern elections. This chapter provides an overview of the role of the Supreme Court of Canada in regulating elections and certain aspects of the democratic process. The first section provides a general overview of the Court’s approach to democracy and elections. The second section focuses on a few representative decisions in order to illustrate the function of the Court in overseeing the electoral process. The third section considers a few challenges facing the judicial supervision of elections and democracy.
