ABSTRACT

Habennas has presented an extensive exposition of his views on law in Between Facts and Norms, first published in Gennan in 1992. He has arrived at the legal problematic through a byway; his background lies elsewhere than in jurisprudence, namely in philosophy and social theory. We can sunnise various reasons for Habennas' interest in law and in the Rechtsstaat. He has confronted the problem of Jaw both in his moral philosophy, in the theory of discourse ethics, and in his social theory and analysis of modem society. But we can even pinpoint to the basic intention of the Frankfurt school: to elaborate,justify and apply a critical yardstick for assessing modem society.
