If the subject matter was first invented in this country by someone else, you cannot obtain a valid patent on it. Further, if the subject matter was described in a printed publication anywhere in the world or was in public use or on sale in this country more than one year prior to the filing date of your patent application, you cannot obtain a valid patent on the subject matter. For all of the various ramifications and nuances attendant to Section 102, you had better see your patent lawyer.
