ABSTRACT

The theory of negligent training is exactly what it is called — namely failing to train and educate or improperly or negligently training or educating employees or management team members. This theory can involve situations where the employer's failure to provide necessary or the required education or training to employees or members of management or conversely where the employer provided training but the training was improper or wrong information was provided to the employees. This chapter explains the case of a former female employee who brought action against her former employer, alleging sex discrimination and retaliation in violation of Title VII and Minnesota Human Rights Act, and for negligent training, retention, and supervision. Federal courts have recognized two types of continuing violations, a series of related acts, one or more of which falls within the limitations period, or the maintenance of a discriminatory system both before and during the limitations period.
