ABSTRACT

Costs incurred by local authorities in carrying out works in default of an owner are recoverable both by proceeding in the County Court and by the debt becoming a charge on the property. They may be recovered from an owner by instalments and with interest. A local authority, by agreement with an owner or occupier of any premises, may undertake on his behalf works which it has required him to carry out under the Act or undertake sewer or drain construction, alteration or repair which the owner or occupier is entitled to execute. The costs are chargeable to the owner or occupier. A local authority may sell any materials which have been removed by them from any premises, including any street, when executing works under the Act, which are not claimed by the owner and taken away by him within three days of the work.
