ABSTRACT

The 1990 Act applies in England and Wales and, with certain amendments, in Scotland. Similar provisions apply in Northern Ireland. In implementing the statutory nuisance procedures, local authorities may not have regard to the radioactive state of any substance, article or premises. These are matters to be dealt with under the environmental permitting regulations 2016. Unless the secretary of state has granted consent, a local authority may not bring summary proceedings for causing a statutory nuisance where proceedings may be brought under the integrated pollution prevention control regime under the pollution prevention and control act 1999 – see FC27. Integrated Pollution Prevention Control installation, may be regulated by the statutory nuisance procedures. Specific powers relating to power of entry to deal with statutory nuisances are provided in schedule 3 to the Environmental Protection Act 1990.
