ABSTRACT

This chapter discusses the legality of interfering with property rights by decisions, and second, with some statutory provisions enabling compensation to be claimed for land value decreases, or other losses, caused by decisions of public authorities. A decision to formulate plans and policies that increase the possibilities of development or the more profitable use of land may cause land value increase; other decisions, such as to revoke a planning permission or to prescribe a building line in connection with a highway, may cause land value decreases. The bank had been refused planning permission for an extension because of a proposed road widening scheme; the bank argued that it was ultra vires to use planning powers because compensation was not payable for a refusal of planning permission. Compensation is payable for the revocation of listed building consent and in connection with building preservation notices.
