ABSTRACT
The Comprehensive Environmental Response, Compensation, and Liability Act of 1980, commonly known as the “Superfund” act or CERCLA, was passed by Congress in response to a growing national concern about release of hazardous substances to the environment. These concerns were directed primarily at inactive sites, but also from actively managed facilities and vessels which are subjected to the Resource Conservation and Recovery Act (RCRA).
