The cost of insurance for asbestos abatement is significant, and if such expense is going to be undertaken, the coverage obtained should be satisfactory. While there are no easy solutions in this decisionmaking process, it is mandatory that contractors, consultants, and owners become knowledgeable purchasers of insurance. A contract is an agreement in which two persons promise to exchange something of value. One well-known legal guideline is the restatement of contracts. It states that a contract is a promise or set of promises for breach of which the law gives a remedy, or which the law recognizes as a duty. A contract which is proper in all important aspects is called valid or completely enforceable. The court may find that asbestos removal is a known dangerous activity, like making fireworks, and even though the contractor complied with all regulations and was careful, he/she still must pay for all damages.
