ABSTRACT

Lest the people believe the measurement of economic damages is a minor aspect of the civil litigation process, overshadowed by the investigation and forensic accounting analysis of liability issues, the author offer the following story from the NY Times: A month ago, Texaco Inc. was one of the nation's strongest companies. At times the people will be asked to provide expert testimony on liability issues and economic damages. It is also important to understand that a plaintiff's economic damages may not be caused entirely by the defendant's wrongful act. Economic damages must not exceed an amount that an analysis of the evidence establishes with reasonable certainty. Recovery of actual monetary losses is precluded under tort law based on the economic loss doctrine. Economic damages were calculated with reasonable certainty.
