ABSTRACT

The concept of ownership forms the foundation of both ancient and modern societies because it guarantees certain rights. Guarding a person’s property and possessions is typically viewed as one of the most sacred laws of justice. In the United States, property ownership and ownership transfer information are legally recorded by county governments per state statutes. The Federal government does not possess modern-day real property transactions and ownership records. Right of way (ROW) is a legal right to create a way through a piece of land. To have this right, a party can either be the owner of the land or has legal permission from the owner of the land. The ROW can be acquired through various mechanisms. A fee-simple purchase, which is based on a seller’s willingness to sell and a buyer’s desire to buy, is most common. The concept and practice of selling and purchasing form the foundation for our economic system.
