ABSTRACT

This chapter discusses the planning regime in England, outlines the process of gaining permission, what the likely costs are of making an application, and explains key terms and roles. If a person planning some building work fails to obtain planning permission, or fails to comply with the details of the permission, then they will be considered to have committed a planning breach. The process of managing the development of buildings and land is known as planning control. Local Planning Authority will organise their own administrative process for enforcing alleged breaches of planning control and will record and investigate complaints about alleged breaches of planning controls. In some areas, the Local Planning Authority may remove some permitted development rights by issuing an Article 4 direction. This is most common in conservation areas where the character of an area is acknowledged to be important and could be threatened by certain types of development.
