ABSTRACT

State laws or regulations shall provide an adequate legal basis for sanitary control of all phases of the harvesting, processing, distribution and shipping of shellfish to interstate markets. This legal authority shall enable one or more departments or agencies of the state to regulate and supervise the source, shipment, labeling and storage of shellfish; the operation of depuration plants; and the shucking, packing, labeling and repacking of shellfish. The state shall also be permitted to certify and decertify interstate shellfish shippers; to conduct laboratory examinations of shellfish; to prevent the sale of unsafe or uncertified shellfish by such legal means as detention, monetary fines, seizure, embargo and destruction; and to suspend interstate shippers certificates in public health emergencies.
