ABSTRACT

As its title explains, this chapter discusses professional indemnity insurance and the concept of the indemnity of the design professional through insurance by way of analysis of court decisions relating to the concept. The typical wording and features of such an insurance policy are examined, also by reference to case law.

The policy wording offered by the insurance market for professional indemnity differs substantially from one insurer to another, but the basic elements are similar and they are explained in this chapter. Various specific memoranda found in such policies are discussed, including the concept of group schemes.
