ABSTRACT

This chapter is written with particular reference to some of the FIDIC forms of contract and the insurance requirements that have been set out therein. In particular, these forms of contract are known by the colour of their cover and it is therefore easier to refer to them using that colour. However, whilst this book deals with various editions of the white, red, yellow, silver, green and gold forms between 1987 and 2001, this chapter deals only with the 2006 White Book and the 1992 Red Book, which provides the standard form of contract between the client and the consultant and the standard form of contract between the owner and the contractor, respectively.

The liability and insurance clauses of the 2006 White Book, Clauses 6 and 9, are explained, followed by an explanation of the relevant clauses of liability, indemnity and insurance in the 1999 Red Book, Clauses 20–25 and 65.

This chapter also contains a lengthy and detailed analysis of a number of court decisions from around the world relating to how certain duties, risks and liabilities are dealt with within these conditions of contract.
