ABSTRACT

The Resource Conservation and Recovery Act of 1976 was enacted for two principal purposes: to regulate hazardous wastes from their generation through their disposal and to protect the groundwater aquifers from the land disposal of hazardous wastes. Report to Congress on Injection of Hazardous Waste include: the location and depth of each well, engineering and construction details of each well, hydrogeological characteristics of overlying and underlying strata, and some others. Section 104 provides that the Environmental Protection Agency (EPA) can act, consistent with the National Contingency Plan, to remove or arrange for the removal of hazardous wastes and provide for remedial action, when there is a release, or substantial threat of a release, which may present an imminent and substantial danger to the public health or welfare The EPA is authorized to begin response actions immediately using trust fund monies. Responsible parties can undertake a response action as a result of EPA enforcement.
