ABSTRACT

This chapter presents a discussion of how to undertake the desperately needed, large-scale changes both nationally and internationally to bring worldwide corporate abuse under control. A Rights of Nature legal system must go hand in hand with ending corporate personhood, liability shields, and corporate capacity to create international subsidiaries or form transnational entities. Corporations-with few exceptions-have used and continue to use an inventive array of legal theories to get supportive court rulings, as illustrated by a few historic and recent examples of their abuse of both natural resources and people in the United States and abroad. Monsanto Company has tried for more than 10 years to censor informed decision-making on the use of synthetic growth hormones in cattle to increase milk production, because it manufactures the only such hormone available in the United States. Combining the successes of the B-Corporation movement with needed legal reforms can end corporate abuse of the environment and communities.
