ABSTRACT

Virtually every jurisdiction has laws which limit the speed at which vehicles can move, and the amount of alcohol and/or drugs under which an individual is lawfully deemed to be capable of safely controlling, or being in charge of, a means of transportation. The underlying principle of such laws is to increase public safety, and the safety of the individual. The faster a person is moving in a vehicle, the greater the risk of loss of control and collision, and the greater the extent and seriousness of injury. The Corporate Manslaughter and Corporate Homicide Act 2007 came into force in 2008 and introduced a new offence across the UK: corporate entities may be prosecuted when there has been a gross failing, throughout the organisation, in the management of health and safety, where such a failure has fatal consequences.
