ABSTRACT

A patient is entitled to see personal information held about them. They are entitled to access to their health records. 'Health records' include all records relating to the patient's health. The patient has the right to rectification if the data is inaccurate. They can apply to court for an order or to the Information Commissioner for an enforcement notice to rectify, block, erase or destroy it. The Act enables a patient to be: informed whether personal data is processed, given a description of the data held, the purpose for which it is processed and to whom the data has been disclosed, given a copy of the information, and given a copy of the information. Many patients want more information about their own condition and treatment choices, even where there is bad news or a difficult diagnosis or even the suspicion of one.
