ABSTRACT

The forensic podiatrist’s role is that of the expert witness. Operating in both civil and criminal courts, such witnesses provide expert evidence, that can include opinion evidence “on scientific and technological matters which are beyond the knowledge and experience or judges and juries” (EWI 2006). Definitions exist in both the United States and the United Kingdom to state precisely what it is that expert witnesses do. In the United States, the Federal Rules of Evidence (FRE) Rule 702 (US Govt. 2009) state the following:

The Frye standard relates to the admissibility of expert testimony and was established by Frye v. the United States, 293 F. 1023 (LII 2016a).
