ABSTRACT

In this chapter, the authors consider tenancies of the home, with specific reference to a range of statutory codes. The provisions apply to residential tenancy agreements which include licences and occupation of lodgers as well as leases. Long leases at low rents enjoy a lower level of statutory protection. Local authorities are clearly public sector landlords, and their tenants have the benefit of secure tenancies under the Housing Act 1985. The statutory code which applies to tenants other than those occupying under a long lease will depend upon the type of landlord granting the lease. Existing tenancy arrangements will be replaced with two types of contract: secure contracts, modelled on secure tenancies, and standard contracts, modelled on assured short hold tenancies. The right to rent, Immigration Act 2014 (IA 2014), is a means of preventing those with no legal right to remain in the UK from renting private rented accommodation.
