ABSTRACT

The law relating to land set out herein is based on the current position in England. The simplifying provisions of the 1925 legislation were long overdue and were intended to facilitate land use and to reduce the cost of transfer. An important aspect of the 1925 legislation is the ability to register title; registration records all pertinent details of ownership on a central register maintained by the Land Registry. Legislation, together referred to as the property statutes, came into effect at the beginning of 1926, reducing the legal estates in land to two – fee simple and leasehold. The owner of the land may maintain an action of trespass against a former licensee remaining after revocation of the licence. An easement is a right in alieno solo attached to the ownership of land and being a right to use or restrict the use of that other land.
