ABSTRACT

This chapter provides an overview of key legislative, regulatory and tax regimes that have historically had, and are having, an impact on residential tenancies. It focuses on the most common different types of private and public sector tenancies, and the legislation underpinning them, with specific reference to three key areas: security of tenure, succession and rent regulation. The chapter also focuses on private residential tenancies, as these are likely to be of interest to a wider audience, but an overview of public sector residential tenancies and also provides long leases. It provides residential tenancies in England and Wales, but reference to the current situation in Northern Ireland and Scotland. There is a wide variety of residential tenancies currently in operation and they differ in the various parts of the United Kingdom. The law relating to residential tenancies is based on a combination of contract law, statute and legal cases and requires specialist knowledge.
