ABSTRACT

This chapter considers the rights which the Old Code contains which entitle the occupier/owner to seek alteration or removal of the apparatus. It deals with an overview of the paragraph and with who may serve a paragraph 20 notice. The chapter also deals with when notice pursuant to paragraph 20 may be served, and also considers what is meant by 'alteration of electronic communications equipment'. It looks at the statutory criteria to which the court will have regard in determining whether or not to make an order for alteration. The chapter considers the orders which may be made by the court, the impact of paragraph 5 of the Old Code, and the question of whether an order may be enforced before the expiry of a fixed term agreement. It deals with who has to bear the costs of effecting removal.
