ABSTRACT

The ATTORNEY-EXPERT relationship starts after the ATTORNEY contacts the EXPERT by means of a letter, or more commonly by phone. The A TTORNEY should ask the EXPERT if he or she is very knowledgeable in the area of toxicology under litigation and whether he or she will be available. If at all possible, the EXPERT should be geographically close to where the trial will take place. The EXPERT should inquire about the ATTORNEY's timetable. (It is not wise to accept an assignment if the trial date is set within a few days, because there will not be enough time for the EXPERT to evaluate the case and do the necessary literature review.) The EXPERT should warn the ATTORNEY as soon as possible during the phone conversation that no confidential information should be revealed. The ATTORNEY will most likely ask the EXPERT about his or her fee schedule.
