ABSTRACT

Many vehicular and marine accidents occur at night. In such instances, it is not uncommon for one party involved in the accident to claim that the headlights, taillights, running lights, warning lights, brake lights, or turn signals of the other vehicle were not on or did not work at the time of the accident. Of course, if the lights were not on at the time of the accident, there is a legitimate issue concerning the visibility of the unlit vehicle and the prudence of the person driving it in that condition.
