Malpractice lawsuits are not won or lost at deposition. The attorneys approach this part of the lawsuit as another process leading toward the trial. The main objective is to get the defendant in a courtroom so that the members of the jury will see why he or she deserves to be burned at the stake. Since the plaintiff’s hired gun is always willing to deal with the issue in a more civilized manner, a settlement in the form of a huge sum of money will be quite satisfactory. If that settlement is equal to the full value of the defendant’s deep pocket, so much the better.
