ABSTRACT

A deposition is not just a record for the court. It is also an opportunity for the plaintiff’s counsel to size up the defendant. The lawyer will be interested in how the doctor dresses, his physical appearance, his presence, his demeanor, and his mannerisms. In addition to giving the lawyer a chance to find out how effectively the doctor’s testimony will benefit the plaintiff’s position, it also gives him or her an overview of the defendant’s credibility. Even though the witness is not answering questions directly to an audience of jurors, the plaintiff’s lawyer will still be able to glean an idea of how he will come across in an open courtroom.
