ABSTRACT

As we mentioned in Chapter eight (Meeting the inquisitor), the lawyer deposing the witness will try to appear harmless and nonthreatening. He is only there to seek information. The same counsel, during a jury trial, will have a whole different demeanor. In the courtroom environment, it is to the plaintiff’s advantage to demonstrate to the jurors how strongly the lawyer believes in his client. Taking a more accusatory position will strengthen the case for negligence or even malicious intent.
