ABSTRACT

The primary value of NEPA is to require an Environmental Assessment (EA)‡ or an Environmental Impact Statement (EIS).§ NEPA also sets national policy regarding the environment to promote the health and welfare of man.¶ Many states now have similar legislation, with similar goals and policy statements to NEPA.** The Supreme Court has stated that NEPA is largely procedural and not primarily substantive in its nature.†† It is possible that federal action involving the issuance of a permit may be enough to activate NEPA’s requirements.‡‡ NEPA functions to require a cost-benefit analysis for major federal projects.§§ This analysis is subject to
