Definition Vicarious liability may be considered a form of strict liability, in that it has no element of fault. This is somewhat different from a liability such as negligence, that requires a breach of duty, and intentional liability, which requires intent or a willful act, and gives rise to an injury or a wrong. Simply defined, vicarious liability places the accusation of liability on one or more persons (or a corporation) for the actions of another.
