Invasion of Privacy There is no doubt that an investigation can cause emotional stress to both the guilty and the innocent. However, if a plaintiff initiates an emotional-distress lawsuit in response to an investigation, he or she must prove that the investigator engaged in some extreme or outrageous conduct that, in fact, caused severe emotional distress resulting in physical symptoms or bodily harm. Thus, every investigator should be cognizant of possible civil action alleging an invasion of privacy when investigating a person’s pre-employment history, violation of company policy, or the report of a crime.
